A hipótese levantada é a de que o jurista é tradicionalmente formado através do estudo dogmático do Direito, que tem, entre outras características, a de utilizar estritamente as linguagens técnico-jurídicas, que por sua vez são manifestações do conhecimento e pensamentos simbólicos. Por esta razão, quando se depara com crises ou situações em que apenas com o uso desta linguagem sequer consegue pronunciar a questão, demonstrando incapacidade para a resolução do problema, este jurista procura alguma outra linguagem, uma metalinguagem. Tal jurista, que estabeleceu contato com metalinguagens com o objetivo de intervir na realidade estabelecida, torna-se um jurista crítico. Todavia, as mensagens decorrentes das articulações ocorridas entre o Direito e estas metalinguagens podem permanecer, ainda, enquanto manifestações do conhecimento e pensamento simbólicos. E isto porque os discursos gerados a partir destas abordagens não geram no receptor da mensagem que propagam aquele sentimento de empatia. Para que este sentimento seja gerado, acredita-se que seja necessário que os discursos trabalhem não somente com o conhecimento e pensamento simbólicos, mas também com o conhecimento e pensamento sensíveis. Deste modo, o jurista que entra em contato com a Arte, de modo geral, e com a Literatura, de modo particular, poderia, através de um exercício do pensamento não apenas simbólico, mas também sensível, formar-se um jurista crítico-sensível. Ao final, a hipótese levantada se mostra parcialmente verdadeira, na medida em que só se concretiza quando o jurista vai ao lugar da literatura de maneira sensível <br>Abstract: The present work has as its theme investigate the possibility of using literature as a privileged place in the formation of a critical-sensitive lawyer and proposes the following question: from the theory of aesthetics of the oppressed, of the Brazilian playwright Augusto Boal, the literature can form the jurist critical-sensitive? The hypothesis is that the jurist is traditionally formed through the study of dogmatic law, which has, among other features, the use of strictly legal technical languages, which in turn are manifestations of knowledge and symbolic thoughts. Therefore, when faced with crises or situations where only using this language cannot even pronounce the issue, demonstrating inability to solve the problem, this jurist seeks some other language, a metalanguage. This lawyer, who established contact with metalanguages aiming to intervene in established reality, becomes a critical jurist. However, the messages arising from the joints occurring between law and these metalanguages can remain still while manifestations of knowledge and symbolic thought. This is because the speeches generated from these approaches do not generate the receiver of the message spread that feeling of empathy. For this feeling is generated is believed to be necessary that the discourses work not only with the knowledge and symbolic thought, but also with the knowledge and sensible thinking. Thus, the lawyer who comes into contact with art in general, and with the literature, in particular, could, through an exercise of thought not only symbolic, but also sensitive, formed a jurist critical-sensitive.
