Tal objeto é analisado a partir da perspectiva das relações interinstitucionais do Supremo Tribunal Federal e o Congresso Nacional, contextualizado na chave entre o controle de constitucionalidade e a democracia representativa. Os problemas da pesquisa podem ser resumidos na seguinte formulação: ao considerar o debate normativo sobre as relações entre o Poder Judiciário e o Poder Legislativo, como é possível descrever e analisar as decisões do Supremo Tribunal Federal em sede de jurisdição constitucional sobre processo legislativo federal no período entre 2011 a 2019? E como perguntas secundárias são apresentadas as seguintes: quais os principais argumentos dispostos pela doutrina do Direito Constitucional contemporâneo referente às relações entre o Poder Judiciário e o Poder Legislativo? A dificuldade de definição da supremacia nas relações entre os poderes está relacionada ao desenho constitucional contemporâneo? Entre os critérios de medição selecionados, quais são as variáveis independentes de maior impacto nas decisões do Supremo Tribunal Federal sobre processo legislativo? O trabalho tem como hipótese que as teorias normativas precisam considerar os resultados das pesquisas empíricas como elemento de direcionamento das análises desenvolvidas, para se evitar análises enviesadas e perda do potencial para a compreensão das relações entre o Poder Judiciário e o Poder Legislativo. A metodologia aplicada foi quantitativa, com pesquisa empírica e análise exploratória, bibliográfica e o uso de técnicas de inteligência artificial para modelagem de dados. No cruzamento das informações se utilizou da análise estatística e de probabilidade, que serviu de fundamento para a regressão logística, sendo assim, com os dados obtidos foi possível apontar tendências de convergência do comportamento decisório dos membros do Supremo Tribunal Federal com as maiorias legislativas ocasionais, de modo a integrar o órgão no sistema político majoritário. Neste ponto destacam-se quatro variáveis quantitativamente relevantes: argumentos de inconstitucionalidade, ato normativo, classe processual e turmas do Supremo Tribunal Federal. Por outro lado, a separação das decisões por temas do processo legislativo e por chefias do Poder Executivo não apresentaram dados quantitativamente relevantes, a considerar o desenho de pesquisa aplicado. Por fim, as conclusões indicam o potencial da interlocução das teorias normativas com as pesquisas empíricas para as análises das instituições, com destaque para um comportamento decisório do Supremo Tribunal Federal com forte convergência às decisões do sistema majoritário e o uso estratégico da possibilidade de julgamentos sem análise do mérito.Abstract: The work has as its theme the relationship between the constitutional jurisdiction and the legislative process in the period 2011-2019. This object is analyzed from the perspective of the interinstitutional relations of the Supreme Court and the National Congress, contextualized in the key between constitutionality control and representative democracy. The research problems can be summarized in the following formulation: considering the normative debate on the relations between the judiciary and the legislative branch, how is it possible to describe and analyze the decisions of the Supreme Federal Court in constitutional jurisdiction over federal legislative process in the period between 2011 and 2019? And as secondary questions are presented the following: what are the main arguments laid down by the doctrine of contemporary Constitutional Law regarding the relations between the judiciary and the legislative branch? Is the difficulty in defining supremacy in the relations between powers related to contemporary constitutional design? Among the measurement criteria selected, what are the independent variables with the greatest impact on supreme court decisions on legislative process? The work has as hypothesis that normative theories need to consider the results of empirical research as an element of direction of the analyses developed, to avoid biased analyses and loss of the potential to understand the relations between the Judiciary and the Legislative Power. The methodology applied was quantitative, with empirical research and exploratory, bibliographic analysis and the use of artificial intelligence techniques for data modeling. In the crossing of the information, the statistical and probability analysis was used, which served as the basis for logistic regression, thus, with the data obtained it is possible to point out trends of convergence of the decision-making behavior of the members of the Supreme Court with occasional legislative majorities, in order to integrate the body into the majority political system, In this point, four quantitatively relevant variables stand out: arguments of unconstitutionality, normative act, procedural class and classes of the Supreme Court. On the other hand, the separation of decisions by themes of the legislative process and by heads of the Executive Branch did not present quantitatively relevant data, considering the research design applied.
