Direito.As inovações tecnológicas representam um grande passo para a humanidade viabilizando coisas que até seriam inimagináveis, no campo da biomedicina, viu se então a possibilidade de armazenar o material genético em clínicas de reprodução assistida, inclusive com o uso do material mesmo após a morte do genitor para viabilizar a concepção de um filho. Embora tenha se vislumbrado um grande avanço no campo da biomedicina, as técnicas de reprodução trouxeram desdobramentos no âmbito jurídico, ao passo que o art. 1597 do Código Civil de 2002, assegura a presunção de paternidade aos filhos concebidos post mortem, entretanto, no art. 1.798 do referido ordenamento, existe previsão que são legitimados a suceder apenas os já concebidos ou nascidos no momento da abertura da sucessão. Ocorre que o ordenamento jurídico, depara-se com um vácuo legislativo, em razão de ausência de legislação específica que aborde a reprodução assistida e acabe a lacuna existente. Nesse sentido, o presente trabalho, busca então efetuar uma análise dos princípios constitucionais, em especial, o da dignidade da pessoa humana, bem como uma análise reflexiva sobre as correntes doutrinárias que tratam sobre o tema, de modo a apresentar soluções que sejam capazes de assegurar e garantir a legitimidade nos direitos sucessórios do filho concebido post mortem, ante a lacuna legislativa.The technological innovations represent a great step for humanity, enabling possibilities that would even be unimaginable, in the field of biomedicine, as seen in the possibility of storing genetic material in assisted reproduction clinics, including the use of the material even after the death of the parent to facilitate the conception of a child. Although there has been a great advance in the field of biomedicine, reproduction techniques have brought developments in the legal sphere, as the article 1597 of the Brazilian Civil Code of 2002 ensures the presumption of paternity to children conceived post mortem, however, in article 1,798 of the aforementioned Code, there is a provision that only those already conceived or born at the time of the opening of the succession are entitled to succeed. Nevertheless the legal system is faced with a legislative vacuum, due to the absence of specific legislation that addresses assisted reproduction and ends the existing gap.
