PUBLIC POLICIES AND HORMONAL TREATMENTS OF LGBTQ+ PUPILS: : POSITIONED BY MINISTRIES OF HEALTH AND JUSTICE

Resumo: The study aims to answer if there are national public policies related to hormonal treatments of LGBTQ + inmates. The database is secondary, built from information provided by the Ministries of Health and Justice, National Penitentiary Department - DEPEN, having a qualitative approach, with periodization determined between 2014 and 2018. It is concluded that the Brazilian prison units obey some determinations of Joint Resolution no. 01/2014, and that there are national public policies related to the hormonal treatments of LGBTQ + inmates. However, it cannot be said that such initiatives materialize in a generalizing sphere, as there are still serious gaps in the implementation of policies, there is no uniformity in oversight regarding the inclusion of LGBTQ + spaces and wings in the units consulted, and invisibility of incarcerated who have opted for gender change and who require maintenance of hormonal treatments or specific health follow-ups.

La base de datos es secundaria, construida a partir de información proporcionada por los Ministerios de Salud y Justicia, Departamento Penitenciario Nacional - DEPEN, con un enfoque cualitativo, con periodización determinada entre 2014 y 2018. Se concluye que las unidades penitenciarias brasileñas obedecen algunos determinaciones de la Resolución Conjunta no. 01/2014, y que existen políticas públicas nacionales relacionadas con los tratamientos hormonales de los reclusos LGBTQ +. Sin embargo, no se puede decir que tales iniciativas se materialicen en una esfera generalizadora, ya que aún existen brechas serias en la implementación de políticas, no hay uniformidad en la supervisión con respecto a la inclusión de espacios y alas LGBTQ + en las unidades consultadas, y la invisibilidad de los encarcelados. quienes han optado por el cambio de género y quienes requieren el mantenimiento de tratamientos hormonales o seguimientos de salud específicos.O estudo tem como objetivo geral responder se existem políticas públicas nacionais relacionadas aos tratamentos hormonais dos apenados LGBTQ+. A base de dados é secundária, construída a partir de informações disponibilizadas pelos Ministérios da Saúde e da Justiça, Departamento Penitenciário Nacional – DEPEN, possuindo abordagem qualitativa, com periodização determinada entre 2014 e 2018. Conclui-se que as unidades prisionais brasileiras obedecem a algumas das determinações da Resolução Conjunta n. 01/2014, e que existem políticas públicas nacionais relacionadas aos tratamentos hormonais dos apenados LGBTQ+. Entretanto, não se pode afirmar que tais iniciativas se materializem em uma esfera generalizante, na medida em que ainda há graves lacunas na aplicação das políticas, não há uniformidade na fiscalização quanto á inclusão de espaços e alas LGBTQ+ nas unidades consultadas, e invisibilidade dos encarcerados que optaram pela mudança de gênero e que carecem de manutenção de tratamentos hormonais ou acompanhamentos de saúde específicos.
