THE ILLICIT ACT OF THE STATE: : A PROBLEM OF “AESTHETICS OF THOUGHT” (ON HANS KELSEN, THE ILLICIT ACT OF THE STATE)

Resumo: | We will try to understand the remarkable strategic value that the thesis of the impossibility (Nichtkönnen) for the State to commit illicit acts had in the work of Austrian jurist Hans Kelsen. This thesis, first stated in 1911 in the Hauptprobleme and later explained in detail in the essay Über Staatsunrecht (“On the illicit act of the state”) of 1913-14, was still totally immersed in the nomostatics and is a logically necessary consequence of the unity of the state’s will (Staatswille), constituting a mandatory step to avoid a serious internal antinomy in the system and the rupture of the unity between the state and the law. The issue is, above all, one of conceptual aesthetics and its solution is in the idea of illegality of the state organ, which cannot fall in any logical contradiction when violating the law since it does not represent the totality of the legal system: in the organ that violates the law, the state ceases to act. As a consequence, the liability of the state for damages caused by its organs becomes possible in the form of civil liability for someone else's fact. |

Esta tesis, enunciada por primera vez en 1911 en el Hauptprobleme y luego explicada en detalle en el ensayo Über Staatsunrecht (“Sobre el Ilícito del Estado”) de 1913-14, estaba todavía totalmente inmersa en la estática jurídica y es una consecuencia lógicamente necesaria de la unidad de la voluntad del Estado (Staatswille), constituyendo un paso obligado para evitar una grave antinomia interna en el sistema y la ruptura de la unidad entre el Estado y el ordenamiento jurídico. El tema es, sobre todo, de estética conceptual y su solución está en la idea del ilícito del órgano estatal, que no puede caer en contradicción lógica al violar la ley ya que no representa la totalidad del ordenamiento jurídico: en el órgano que viola la ley, el Estado deja de actuar. En consecuencia, la responsabilidad del Estado por los daños causados por sus órganos se hace posible bajo la forma de responsabilidad civil por hecho ajeno.No presente trabalho, tentaremos entender o notável valor estratégico que a tese da impossibilidade (Nichtkönnen) para o Estado de cometer ilícitos possuía na obra do jurista austríaco Hans Kelsen. Tal tese, afirmada pela primeira vez em 1911 nos Hauptprobleme e depois explicada em detalhes no ensaio Über Staatsunrecht (“Sobre o ilícito do Estado”) de 1913-14, nasce ainda totalmente imersa na estática jurídica e é uma consequência logicamente necessária da unidade da vontade estatal (Staatswille), constituindo uma passagem argumentativa obrigatória para evitar uma grave antinomia interna do sistema e a ruptura da unidade entre Estado e ordenamento jurídico. A questão é, sobretudo, de estética conceitual e sua solução encontra-se na ideia de ilícito do órgão, que, não representando a totalidade do ordenamento jurídico, não incorre em nenhuma contradição lógica ao violar o direito: no órgão que viola o direito, cessa de agir o Estado.
