UBER AND REINVENTION OF ADMINISTRATIVE LAW: THE NEW BORDERS OF THE REGULATION OF ECONOMIC ACTIVITIES

Resumo: Ever since the state changed its role as the passive guarantor of freedoms to a provider of utility and services, a series of activities of economic nature that once were in charge of private enterprises began to be understood, to some extent, as competence of the State. Even if not the sole provider of the service, state power came to believe that those utilities and services with economic content should at least be regulated and supervised by structures created for that purpose. An immense arsenal of mechanisms of permission, control, verification and normalization of activities with economic potential. The present article aims to discuss how the traditional system of regulating taxi services has been abruptly deconstructed by the UBER concept, imposing an unshakeable redefinition of the State in its role of allowing, regulating and supervising activities with economic potential that are within the scope of the new shared economy.

Aunque no prestase de forma exclusiva a los particulares, el poder estatal pasó a considerar que aquellas utilidades y servicios con contenido económico deberían ser al menos regulados y fiscalizados por estructuras creadas para tal fin. Por lo tanto, surge un inmenso arsenal de mecanismos de permiso, control, verificación y normatización de actividades con potencial económico. El presente artículo pretende discurrir sobre cómo el tradicional sistema de regulación de los servicios de taxis fue abruptamente desconstruido por el "concepto" UBER, imponiendo una inefable redefinición del Estado en su papel de permitir, regular y fiscalizar actividades con potencial económico que estén en el ámbito de la nueva economía compartida.Desde que o Estado mudou sua feição de garantidor passivo das liberdades para provedor de utilidade e serviços, uma série de atividades de natureza econômica que antes gravitavam no espaço da iniciativa privada passou a ser entendida, em alguma medida, como de competência do poder público. Ainda que não prestasse de forma exclusiva aos particulares, o poder estatal passou a considerar que aquelas utilidades e serviços com conteúdo econômico deveriam ser ao menos regulados e fiscalizados por estruturas criadas para tal fim. Surge, assim, um imenso arsenal de mecanismos de permissão, controle, verificação e normatização de atividades com potencial econômico.
