Resumo: We observe an increasing concern with the phenomenon of self-plagiarism in the Brazilian academic environment. However, as this debate is still incipient on legal research, the problem remains raising questions and controversies, which increases the diffuse sense of insecurity among the various actors involved in the process: editors, authors, researchers, regulatory and research funding agencies in the undergraduate and graduate educations, among others. Through bibliographic research and observation, we used the hypothetical-inductive pathway, with the objective of mapping correlations between the homogenizing model of traditional legal education, academic productivism and the spread of self-plagiarism. We do not intend to establish a climate of "witch-hunt", but we understand that the scarcity of this debate can lead to a violation of the ethical imperatives of meritocracy, due to the unfair competition as a result of the distortion in the number of publications; which, on a macro level, implies in an increased redundancy and stagnation of legal knowledge.

Pero como esta discusión aún es incipiente en la investigación jurídica, el problema sigue suscitando dudas y controversias, lo que aumenta la sensación difusa de inseguridad entre los diversos actores involucrados en el proceso: editores, autores, investigadores, agencias reguladoras y fomentadoras de investigación y de posgrado, entre otros. Por medio de investigación bibliográfica y de observación, utilizamos la vía hipotético-inductiva, con el objetivo de mapear posibles correlaciones entre el modelo homogeneizante de la enseñanza jurídica tradicional, el productivismo académico y la expansión del autoplagio. No tenemos la intención de instaurar un clima de "caza de brujas", pero entendemos que la escasez de este debate puede dar lugar a la violación de los imperativos éticos de la meritocracia, debido a la competencia desleal derivada de la distorsión de resultados; implicando, en un plan macro, aumento de la redundancia y del estancamiento del conocimiento jurídico.Observamos uma preocupação cada vez maior com o fenômeno do autoplágio no meio acadêmico brasileiro. Mas como essa discussão ainda é incipiente na pesquisa jurídica, o problema permanece suscitando dúvidas e controvérsias, o que aumenta a sensação difusa de insegurança entre os diversos atores envolvidos no processo: editores, autores, pesquisadores, agências reguladoras e fomentadoras de pesquisa e de pós-graduação, entre outros. Por meio de pesquisa bibliográfica e de observação, utilizamos a via hipotético-indutiva, com o objetivo de mapear possíveis correlações entre o modelo homogeneizante do ensino jurídico tradicional, o produtivismo acadêmico e a expansão do autoplágio.
