Resumo: This paper discusses the importance of the mandated curriculum as safeguard of education quality and therefore of the right to education. This right, which is recognized in a large number of international and national treaties, is of a great importance both for the individual and for society but it is carried out differently in each country depending on its socio-economic, political and cultural contexts. From an overall perspective of this right, a quality education is required, so that every student acquires some basic learning. Not all of mandated curricula are able to ensure the right to education, because some of them do not present basic and essential learning. We propose to include a basic curriculum in every mandated curriculum as a useful tool to ensure the right to education for every learner.

Este derecho, reconocido en numerosos tratados nacionales e internacionales, resulta de gran trascendencia tanto para el individuo como para la sociedad, y presenta una realidad muy diferente de realización en los diferentes países, según sea el contexto socio-económico, político y cultural de cada uno de ellos. Partiendo de una perspectiva amplia de este derecho, se necesita una educación de calidad, en la que todos los alumnos adquieran unos aprendizajes fundamentales. No todos los curricula prescritos por el legislador están en condiciones de garantizar el derecho a la educación, pues hay algunos que no presentan unos elementos curriculares básicos e imprescindibles. Planteamos la inclusión de un currículum básico en cualquier currículum prescrito como herramienta útil para garantizar el derecho a la educación a todo el alumnado.Este artigo aborda a importância do currículo prescrito como salvaguarda da qualidade educacional e, portanto, do direito à educação. Esse direito, reconhecido em inúmeros tratados nacionais e internacionais, é de grande importância para o indivíduo e para a sociedade e apresenta uma realidade de realização muito diferente em diferentes países, dependendo do contexto socioeconômico, político e cultural de cada um. um deles. Com base em uma ampla perspectiva desse direito, é necessária uma educação de qualidade, na qual todos os alunos adquiram aprendizados fundamentais. Nem todos os currículos prescritos pelo legislador estão em posição de garantir o direito à educação, pois existem alguns que não possuem elementos curriculares básicos e essenciais.
