Resumo: The present study has the scope to analyze the Jury's Court from a constitutional perspective in confrontation with a punitive media, addressing the apparent confrontation between fundamental rights, freedom and procedural guarantees against freedom of expression. In view of the complexity of the topic, it was necessary to analyze the jury from a historical perspective, as a fundamental right and guarantee of a formal nature. On the other hand, the examination of sociological and criminological issues showed a new perception of crime and of the criminal. In this context, solutions have been presented for the protection of fundamental rights and guarantees.

Diante da complexidade do tema foi necessário analisar o júri de uma perspectiva histórica, como direito e garantia fundamental de natureza formal. Em contrapartida, o exame de questões sociológicas e criminológicas demonstrou uma nova percepção do crime e do criminoso.
