This paper discusses the legitimacy of the succession of a partner as a necessary heir and their right to the reserved portion of the estate, based on the recognition of stable unions as family entities by the Constitution of the Federative Republic of Brazil, while the 2002 Civil Code did not expressly declare the status of the partner as a necessary heir, although it does recognize their right to compete for succession with the descendants and ascendants of the deceased. To this end, the deductive method was used in order to build a cohesive and logical system with regard to the qualification of the partner as a necessary heir. Finally, the research lists a systematic approach to the concepts, principles and procedures that can be applied to this legal modality, with the aim of developing a proper analysis of articles 1.845 and 1.790 of the CC/2002 in the light of the STF's General Repercussion 809/2017 and Enunciation 641 of the VIII Civil Law Conference.
