Resumo: Este estudo tem como finalidade abordar a Teoria Serendipidade, o encontro da prova fortuita oriundo de uma medida cautelar a interceptação telefônica decreta durante as investigações criminais e instruções processuais penais. O trabalho visa analisar a interpretação doutrinária e jurisprudencial sobre a teoria da serendipidade na interceptação telefônica com fulcro na lei n° 9.296/96.
