Resumo: The SARS-CoV-19 pandemic temporarily modified several social processes, including migration. This exploratory and descriptive research investigates the causes of the high Venezuelan migratory flow to the Federative Republic of Brazil, the normative construction in response to the humanitarian crisis that had been established and how the Brazilian State dealt with the migratory flow during the SARS-CoV pandemic -2, commonly called COVID-19. It also explores the Originary Action 3121 of the State of Roraima and the State Decree 25.681 of 2018 and its consequences. To this end, academic articles, books and theses selected from the Google Scholar repository and information from international bodies will be analyzed, in addition to the regulations in force at the time. The results show that a legal adequacy is necessary to face contexts not covered by the legislation, given the discretion in decision-making that directly affect the guarantee of human rights.

Essa pesquisa de caráter exploratório e descritivo investiga as causas do alto fluxo migratório venezuelano para a República Federativa do Brasil, a construção normativa como resposta à crise humanitária que fora instaurada e como o Estado brasileiro lidou com o fluxo migratório durante a pandemia de SARS-CoV-2, comumente chamada de COVID-19. Explora, também, a Ação Originária 3121 do Estado de Roraima e o Decreto Estadual 25.681 de 2018 e seus desdobramentos. Para tal, serão analisados artigos acadêmicos, livros e teses selecionadas no repositório Google Acadêmico e informativos de órgãos internacionais além das normativas vigentes à época.
