Resumo: The purpose of this monograph is to study the institute of conflict mediation, as an appropriate means of conflict resolution and an effective form of manifestation of the law in all its aspects. It is intended to demonstrate that mediation, now duly regulated in Brazil, a positivist country by nature, is a way of bringing society the right in its essence, enabling all individuals to achieve a fundamental and human law basic, access to justice. Through the dialogue we seek the construction for the resolution of the conflict while working the autonomy and awareness about the individual and collective rights.
