Inovações no pregão eletrônico em face da nova lei de licitações (Lei 14.133/2021)

The theme approached in this work demonstrates the relevance of the analysis and exposition of the bidding modality of the auction, in face of the issuance of the new bidding law. With the enactment of Law 14,133 of April 1, 2021, the evolution and notoriety of the Auction is verified, taking shape (article 28, item I) and prominence brought by the new Law on Public Procurement and Administrative Contracts. In addition to the speed caused by the bidding in this modality, it is still possible to consider the aspect of increasing competitiveness. Thus, with the advent of the electronic auction, it is perfectly possible for companies from all States of the Federation to compete in the event free of charge, generating savings for the public purse. Furthermore, by conducting a tender by digital means, there is also a guarantee of impersonality and isonomy, substantially minimizing situations of collusion, cartel, directions under members of the conducting and technical committee of the event. In addition, let us not forget the prism of publicity and transparency, since all acts performed by the parties are registered in a public access system, which also facilitates monitoring by the control bodies in a more effective way.This time, analyzing and exposing the modality of the electronic auction, before the new bidding law, means that the changes that have occurred occur in terms of the importance and necessity of use, as a rule, the modality, with significant advances and notoriety in its application and relevance.
