Resumo: This article discusses the innovations made by Law 13.964/2019 and the implementation of the Judge of Guarantees. Therefore, it will cover the legislative process that first incorporated this figure, encouraging a reflection on the current police investigation and on criminal procedure, discussing technical aspects that changed, such as legality control, filing, and pretrial detention. Lastly, the main arguments brought up by the Direct Actions of Unconstitutionality 6298, 6299, and 6300, which seek to prevent the inauguration of this figure within Brazilian law, will be analyzed.
