Resumo: | Artificial intelligence (AI) actively participates in the human world because it simulates the capacity of thinking similarly to that of the human being and can even create inventions. Therefore, one must question who would be the holder of the patent for the invention developed by systems endowed with artificial intelligence when there is no direct human interference? To answer this problem the deductive approach method is used, and the structuralism and historical methods of procedure are used. In the end, it was verified that analyzing the current Intellectual Property Law, the ideal would be a reformulation that would embrace the theme. However, in order not to leave this right uncovered, the best way is to adopt the understanding of the National Institute of Industrial Property, in the sense of granting ownership of inventions generated by systems endowed with AI to those who created the system. |

Diante disso, cumpre questionar quem seria o titular da patente referente à invenção desenvolvida por sistemas dotados de inteligência artificial quando não há interferência humana direta? Para responder tal problemática, utiliza-se o método de abordagem dedutivo e como métodos de procedimento empregam-se o estruturalista e histórico. Assim, ao final, verificou-se que, analisando a Lei de Propriedade Intelectual atual, o ideal seria uma reformulação que abarcasse a temática.
