The historical-political-constitutional process of indigenous rights in the Brazilian constitutions from 1824 to 1988

Resumo: Throughout the Brazilian constitutional and legal historical construction, the indigenous communities were invisible. Only in the Federal Constitution of 1988 they obtained the break of the Indian policy with the guarantee of the right to multiculturalism. The role played by indigenous leaders was of significant importance since they also conquered the recognition of land rights. Based on this finding, this article seeks to reconstruct the constitutional historical-political process of indigenous rights in the Brazilian Constitutions from 1824 to 1988. To achieve this central objective, we opted to conduct a bibliographic and documentary research, which focused on the main texts related to the theme and documentary material from primary sources, such as newspapers of the time. It was found that the rights guaranteed in each political Charter are closely related to the political interests of the legislative body of each era. It is concluded that popular participation in the creation of a Constitution occurred only with the Federal Constitution of 1988, when the indigenous communities acted as protagonists of their rights within the Magna Carta of 1988.

Para alcanzar este objetivo central, se optó por realizar una investigación de carácter bibliográfico y documental, que examinó los principales textos relacionados con el tema y material documental de fuentes primarias, como periódicos de la época. Se ha constatado que los derechos garantizados en cada Carta política están estrechamente relacionados con los intereses políticos del cuerpo legislativo de cada época. Se concluye que la participación popular en la creación de una Constitución ocurrió sólo con la Constitución Federal de 1988, momento en que las comunidades indígenas actuaron como protagonistas de sus derechos dentro de la Carta Magna de 1988.Ao longo da construção histórica constitucional e legal brasileira, as comunidades indígenas estiveram na invisibilidade. Apenas na Constituição Federal de 1988 houve o rompimento da política indigenista com a garantia do direito ao multiculturalismo. Para isso, o papel desempenhado pelas lideranças indígenas foi de significativa relevância à conquista e ao reconhecimento de direitos de ordem fundiária. Com base nessa constatação, este artigo busca reconstruir o processo histórico-político constitucional dos direitos indígenas nas Constituições brasileiras de 1824 a 1988. Em vista de alcançar esse objetivo central, optou-se por realizar uma pesquisa de caráter bibliográfico e documental, a qual debruçou-se sobre os principais textos relacionados ao tema e material documental de fontes primárias, como jornais da época. Constatou-se que os direitos assegurados em cada Carta política estão estritamente relacionados aos interesses políticos do corpo legislativo de cada época.
