Resumo: The purpose of this entry is to consider the terms race and racism as legal concepts, but, more than that, as terms of resistance within the field of law. To do so, it draws upon the meanings produced by Black intellectuals throughout history who have redefined the notion of race – and, alongside it, have also given meaning to the notion of racism – shifting it from a biological description to a signification of processes, practices, behaviors, constructions, and social discourses regarding individuals and groups. These redefine and create "statuses" and "social positions" within a social dynamic of hierarchy and white supremacy. The objective is to use legal language based on the understanding that it is performative, requiring ethical commitments in its usage. This commitment includes, here, employing concepts produced by and within Black movements to enable the development of legal concepts that serve as tools of resistance.

Para ello, se basa en los significados producidos por intelectuales negros a lo largo de la historia que han reinterpretado la noción de raza, y junto a ella, han dado también significado a la noción de racismo, desplazándola de una descripción biológica a una significación de procesos, prácticas, conductas, construcciones y discursos sociales sobre los sujetos y grupos, creando "estatus" y "lugares sociales" en una dinámica social de jerarquía y hegemonía blanca. El objetivo es utilizar el lenguaje jurídico basándose en la idea de que es performativo, exigiendo compromisos éticos en su uso. Este compromiso incluye, aquí, emplear conceptos producidos por y dentro del movimiento negro para posibilitar el desarrollo de conceptos jurídicos que sirvan como herramientas de resistencia.A proposta deste verbete é a de pensar os termos raça e racismo como conceitos jurídicos, mas, mais do que isto, como termos de resistência dentro do Direito. Para tanto, utiliza dos sentidos produzidos por intelectuais negras/os ao longo da história que ressignificaram a noção de raça – e, ao seu lado, deram também sentido à noção de racismo – deslocando-a de uma descrição biológica para uma significação de processos, práticas, condutas, construções e discursos sociais a respeito dos sujeitos e grupos e que cria “status” e “lugares sociais” em uma dinâmica social de hierarquia e hegemonia branca.
