The hypervulnerability of children and adolescents from traditional terreiro communities in Brazil: evidence of systematic discrimination

Resumo: Children and adolescents from traditional terreiro communities undergo a double process of fragility, due to their vulnerability and belonging to so-called minority groups, which places them in a situation of hypervulnerability. Thus, the present text fulfills the objective of presenting three cases, Araçatuba (2020), Campinas (2021) and João Pessoa (2019), that evidence the limitation of the family power of mothers who adhere to African-derived religions. To this end, it deals with communities in the racial and social dimensions of their foundations, hypervulnerability and exposes the cases, using the interaction between the IHRL systems and the Brazilian Law, concluding by the distortion, by State agents, of the protection institutes and inclination towards confirm the initial hypothesis.

Los niños y adolescentes de las comunidades tradicionales de terreiro pasan por un doble proceso de fragilización, debido a su vulnerabilidad y a su pertenencia a los llamados grupos minoritarios, lo que les coloca en una situación de hipervulnerabilidad. Así, el presente texto cumple el objetivo de presentar tres casos, Araçatuba (2020), Campinas (2021) y João Pessoa (2019), que muestran la limitación del poder familiar de las madres adeptas a las religiones de matriz africana. Por lo tanto, trata de las comunidades en las dimensiones racial y social de sus fundaciones, de la hipervulnerabilidad y expone los casos, utilizando la interacción entre los sistemas de DIDH y del Derecho brasileño, concluyendo con la detención, por agentes del Estado, de los institutos de protección e incluso a la confirmación de la hipoteca inicial. Crianças e adolescentes de comunidades tradicionais de terreiro passam por um duplo processo de fragilização, em razão de sua vulnerabilidade e de sua pertença aos chamados grupos minoritários, o que as coloca em um quadro de hipervulnerabilidade. Assim, o presente texto cumpre com o objetivo de apresentar três casos, Araçatuba (2020), Campinas (2021) e João Pessoa (2019), que evidenciam a limitação do poder familiar de mães adeptas às religiões de matriz africana. Para tanto, trata das comunidades nas dimensões raciais e sociais de suas fundações, da hipervulnerabilidade e expõe os casos, utilizando a interação entre os sistemas de DIDH e do Direito brasileiro, concluindo pela deturpação, por agentes do Estado, dos institutos de proteção e inclinação à confirmação da hipótese inicial.
