Resumo: | Introduction: At the beginning of President Janir Messia Bolsonaro's government, the Constitution Amendment was promulgated 95/2016, which froze public spending for 20 years, thus limiting the already tight budget for health to 15% of the current net revenue, which is the sum collected by the government, less transfers mandatory provisions of the Constitution. This article deals with the activist performance of the judiciary in the face of realization of the fundamental right to health, given the budgetary limitations of public health. Objective: to analyze the phenomenon of judicial activism and the legitimacy, limits and possibilities of the judiciary in the search for realization of the right to health. Methodology: it is a bibliographic review, of qualitative character, of literature, doctrines, laws and similar jurisprudence, available in the databases of BDTD (Biblioteca Brazilian Digital of Theses and Dissertations); Plataforma Sucupira, SciELO (Scientific Electronic Library Online); CONPEDI; LexML Brasil; GlobaLex; CAPES Thesis Bank and the TJDFT portal. Results: In the period of the study, 528 judgments were recorded; 2,238 appellate class judgments; 3 Incident judgments repetitive demands - IRDR; 44 Case law reports and 129 case law on the TJDFT theme, totaling 2,949 processes dealing with health matters. Conclusion: Faced with the inertia of the executive and legislative power, the judiciary, provoked by popular claims has been acting in an activist and proactive realization of fundamental rights, creating a movement of judicial citizenship, a stance supported by its function prescipates to ensure the effective fulfillment of the constitutional statements, however with excesses, crashing the competence that was conferred by the Constituent Power. |

Este artículo aborda el desempeño activista del poder judicial con respectoa la realización del derecho fundamental a la salud, en vista de las limitaciones del presupuesto de salud pública.Objetivo: analizar el fenómeno del activismo judicial y la legitimidad, límites y posibilidades de la judicatura en labúsqueda de la realización del derecho a la salud. Metodología: es una revisión bibliográfica, de caráctercualitativo, de literatura, doctrinas, leyes y jurisprudencia similar, disponible en las bases de datos de BDTD(Biblioteca Digital Brasileña de Tesis y Disertaciones); Plataforma Sucupira, SciELO (Biblioteca electrónicacientífica en línea); CONPEDI; LexML Brasil; GlobaLex; Banco de Tesis CAPES y el portal TJDFT. Resultados:Durante el período de estudio, se registraron 528 juicios; 2,238 sentencias de clase de apelación; 3 juicios deincidentes de demandas repetitivas - IRDR; 44 boletines de jurisprudencia y 129 jurisprudencia sobre el temaTJDFT, por un total de 2,949 casos relacionados con asuntos de salud. Conclusión: frente a la inercia del poderejecutivo y legislativo, el poder judicial, provocado por reclamos populares, ha estado actuando de manera activistay proactiva en la realización de los derechos fundamentales, creando un movimiento de ciudadanía judicial, unapostura respaldada por su función para garantizar la aplicación efectiva de las declaraciones constitucionales, perocon excesos, escalonando la competencia conferida por el Poder Constituyente.Introdução: No inicio do governo do Presidente Jair Messias Bolsonaro foi promulgada a Emenda a Constituição 95/2016, que congelou os gastos públicos por 20 anos, limitando assim, o já apertado orçamento destinado a saúde pública à 15% da receita corrente líquida, que é o somatório arrecadado pelo governo, deduzido das transferências obrigatórias previstas na Constituição. O presente artigo trata da atuação ativista do poder judiciário frente a concretização do direito fundamental a saúde, frente as limitações orçamentárias da saúde publica. Objetivo: analisar o fenômeno do ativismo judicial e a legitimidade, limites e possibilidades do poder judiciário na busca da concretização do direito à saúde. Metodologia: trata-se de uma revisão bibliográfica, de caráter qualitativo, de literaturas, doutrinas, legislações e jurisprudências afins, disponíveis nos bancos de dados da BDTD (Biblioteca Digital Brasileira de Teses e Dissertações); Plataforma Sucupira, SciELO (Scientific Electronic Library Online); CONPEDI; LexML Brasil; GlobaLex; Banco de Teses da CAPES e no portal do TJDFT. Resultados: No período do estudo constatou-se o registro de 528 acórdãos; 2.238 acórdãos de Turmas Recursais; 3 acórdãos de Incidentes de demandas repetitivas ”“IRDR; 44 Informativos jurisprudenciais e 129 jurisprudencia em tema do TJDFT, totalizando 2.949 processos tratando da matéria de saúde.
