Afasta a responsabilidade civil e penal do parlamentar, que estará imune pelas opiniões, palavras e votos que emitir no exercício de seu mandato. Com origem inglesa, no Bill of Rights, a prerrogativa foi expressamente prevista no art. 16 da Declaração dos Direitos do Homem e do Cidadão, de 1.789, e disseminou-se, alcançando praticamente todas as ordens constitucionais vigentes. Também denominada imunidade parlamentar material, o instituto figurou em todas as Constituições brasileiras e está inserido no art. 53, caput, da Carta vigente, com redação dada pela Emenda Constitucional n. 35/2.001. Os limites e alcance da prerrogativa, entretanto, variaram, em decorrência da configuração que cada Constituição atribuiu-lhe. A esse respeito, a doutrina e a jurisprudência prestaram grande contribuição. O Supremo Tribunal Federal havia assentado a tese segundo a qual o instituto somente imunizaria o parlamentar quando houvesse conexão entre a declaração emitida e o exercício do mandato. Em 2003, esse entendimento foi alterado. O Acórdão paradigma refere-se ao Inquérito n. 1.958. Desde então, ficou estabelecida distinção fundada no local em que ocorreu a declaração. Para as manifestações ocorridas na sede do Parlamento, a prerrogativa assumiria contornos absolutos, não havendo que se perquirir sobre a pertinência entre o teor das afirmações e o exercício do mandato. No caso de declarações ocorridas fora do parlamento, o congressista somente estaria imune quando verificado nexo de implicação recíproca entre o teor da manifestação e o desempenho do mandato. O objeto do presente trabalho consistiu em analisar se é juridicamente adequado o estabelecimento de critério fundado no local em que ocorreu a manifestação para verificar a incidência da prerrogativa. Com apoio na doutrina e na jurisprudência do Supremo Tribunal Federal, a pesquisa avançou, concluindo que o espaço físico do Parlamento não constitui critério suficiente para estabelecer o elo jurídico com o exercício do mandato. Primeiramente, verificou-se contradição no Acórdão paradigma: embora reconheça que as imunidades parlamentares destinem-se a viabilizar o exercício independente do mandato, argumenta que, no caso de opiniões, palavras e votos proferidos na sede do Parlamento, o congressista manter-se-ia inviolável, ainda que tais manifestações não guardem qualquer conexão com o exercício do mandato. O novo entendimento do Tribunal também diferenciou os parlamentares do cidadão comum. A inexistência de fundamento autorizador para a diferenciação configura quebra da isonomia. A razão de discrímen utilizada, o espaço físico do parlamento, não encontra amparo constitucional. Admiti-lo representaria transformar a prerrogativa em privilégio. Verificou-se, ainda, que a inviolabilidade parlamentar constitui princípio constitucional e como tal, deve ser compatibilizado com outros valores de igual envergadura. Assim, no caso concreto, eventual conflito deveria resolver-se segundo um juízo de sopesamento para viabilizar, tanto quanto seja possível, a satisfação de ambos. This removes the civil and penal responsibility from the members of Parliament, who possess an immunity regarding the opinions, words, and votes emitted during their mandate. The prerogative was expressly laid out in Article 16 of the Declaration of Rights of the Declaration of the Rights of the Man and the Citizen, in 1789, and spread until reaching practically all of the existing constitutional orders. Also referred to as “material parliamentary immunity,” the statute is included in all Brazilian constitutions and was inserted into Article 53, caput, of the current code in writing of the 35th Constitutional Amendment, in 2001. The limits of the prerogative’s reach, however, vary in accordance with the value each constitution gives to it. In this respect, doctrine and jurisprudence make a large contribution. The Federal Supreme Court has set down the thesis that the institute would only offer immunity to the Parliament member when there was a connection between the emitted declaration and the fulfillment of the mandate. In 2003, this understanding was altered. The Acórdão Paradigm refers to Inquest 1,958. From that, a founding distinction was established in the place at which the declaration occurred. For demonstrations in Congress, the prerogative would assume absolute proportions, not having to investigate about the pertinence between the content of the affirmations and the fulfillment of the mandate. In the case of declarations made outside of Parliament, the member of Congress would only have immunity when there was a reciprocal nexus of implication between the content of the declaration and the performance of the mandate. The objective of the current work consisted in analyzing if it is legally adequate to establish founding criteria in the locale in which the declaration of the incidence of the prerogative occurred. With the help of the doctrine and jurisprudence of the Federal Supreme Court, the research advanced, concluding that the physical space of the Parliament did not constitute sufficient criteria to establish the judicial link with the performance of the mandate. Firstly, verifying a contradiction in the “Acórdão Paradigm”: even though it is recognized that the Parliamentary immunity is intended for the independent performance of the mandate, it argues that, in the case of opinions, words and Parliamentary votes, the member of Congress can be maintained inviolable, even if such manifestations do not contain any connection with the completion of the mandate. The new understanding of the Supreme Court also differentiated the members of Parliament from the common citizen. The inexistence on a fundamental authorizing agent for the differentiation breaks the equality. In reason of utilizing the discrimination, the physical space of the parliament does not encounter constitutional support. To admit it would mean to transform the prerogative into a privilege. Checking that, even so, the inviolability of Parliament constitutes a constitutional principal and as such should be compatible with other values of equal breadth. As such, in the concrete case, eventual conflict should be resolved following a supposition, in as much that it is possible, the satisfaction of both.
