Foi neste contexto de fragilização da tutela da intimidade e da vida privada que o debate sobre o direito ao esquecimento ganhou maior destaque, já que este pretende evitar a perenização de informações acerca de fatos pretéritos e relativos à vida privada do indivíduo pelas novas tecnologias de comunicação. Desse modo, nota-se que a aplicabilidade do direito ao esquecimento dependerá de uma ponderação de interesses existenciais que envolva, de um lado, os direitos à liberdade de expressão e de manifestação do pensamento, e do outro, os direitos à privacidade, à intimidade, à imagem, à honra e à identidade pessoal. O presente estudo pretende apontar alguns critérios que vêm sendo utilizados pela jurisprudência brasileira e internacional na solução de eventuais conflitos de interesses que envolvam o direito ao esquecimento. Para tanto, serão analisados julgamentos do Superior Tribunal de Justiça e do Tribunal de Justiça da União Europeia bem como a legislação brasileira relativa à proteção de dados pessoais, mais especificamente os dispositivos da Lei 12.965/2014. It was in this context of weakening the protection of privacy that the debate about the right to be forgotten was highlighted as it tried to refrain the perpetuation of information about past events, and about an individual past private life, in the new technologies of communication. Thus, the applicability of the right to be forgotten will depend on a consideration of existential interests involved, on the one hand, the rights of freedom of expression and expression of thought, on the other, the rights to privacy, intimacy, image, honor and to personal identity. The present study intends to point out some criteria that have been used by Brazilian and international jurisprudence for the solution of eventual conflicts of interest that involve the right to be forgotten. In order to do so, sentences from the Superior Court of Justice and the Court of Justice of the European Union, as well as Brazilian legislation about the protection of personal data, especially the provisions of Brazilian Law n. 12.965/2014, will be analyzed.
