A escassez de recursos públicos para a garantia do direito de acesso aos serviços de saúde vem, cada vez mais, levando aqueles que dependem de tais serviços a se socorrerem da intervenção do Poder Judiciário para a garantia de seus direitos fundamentais preconizados na Constituição Federal. Por outro lado, os administradores responsáveis pela gestão das políticas públicas de saúde enfrentam - em um cenário de escassez de seus recursos – dificuldades crescentes em atender às ordens judiciais e às necessidades apresentadas pela população, bem como em fazer com que os recursos restantes redundem em um atendimento eficaz para tais demandas. Em meio a tal contradição, encontra-se o Poder Judiciário com a incumbência de decidir, em sede de demandas individuais e coletivas, o direito aplicável a cada caso. Na presente discussão, posicionamentos e formulações teóricas apontam para diversas direções, seja defendendo a autonomia da Administração frente ao Judiciário ou defendendo a inafastabilidade do controle jurisdicional, seja defendendo a proteção de interesses coletivos frente a interesses individuais, seja defendendo a dignidade da pessoa humana e o respeito ao mínimo existencial. Nesse contexto, diversos acadêmicos e magistrados abordam o tema conforme suas convicções sobre o direito aplicável a tais casos, buscando-se sempre um meio-termo entre a proteção de direitos fundamentais individuais, direitos fundamentais coletivos e as prerrogativas da Administração Pública. _____________________________________________________________________________ ABSTRACTThe proposing of lawsuits about the provision of public health services is a phenomenon which has been becoming increasingly common in brazilian society. The scarcity of public resources to ensure the right to access public health services has been, more and more often, making those which depend on such services for their own survival to require the Judiciary's intervention in order to ensure of fundamental rights ensured by the Federation's Constitution. On the other hand, the managers of the public health policies face – in a scarce resources picture – increasing challenges in order to attend the judicial orders and the needs presented by the general population, as well as turning the remaining financial resources in an effective service to attend such requirements. Amid such contradiction, the Judicial Power finds itself with the obligation of deciding, both in the singular and in the collective demands, the law which should be applied to each case. In the present discussion, theoretical positioning and formulations point towards many directions, either defending the autonomy of the public administration in relation to the judiciary or defending impossibility of denial of the jurisdiction decision, in times defending the need to protect collective rights against individual rights, or in other times defended the human dignity and the respect of the existential minimum.
