Para tanto, em um primeiro momento, será realizado retrospecto histórico do quadro de transformações que a Reforma Gerencial trouxe para o Brasil na década de 90. Nesse contexto, serão examinadas as Emendas Constitucionais nº 9 e nº 19, de 1995 e 1998, as quais, respectivamente, relativizaram o monopólio do petróleo e instituíram a necessidade de um estatuto jurídico próprio para as empresas públicas e as sociedades de economia mista que explorem atividades econômicas. Sobre essas entidades, convém esclarecer, que serão apresentados maiores detalhamentos acerca do regime jurídico ao qual se submetem, de forma a dar enfoque, principalmente, sobre a temática de licitações e contratações. Em seguida, o caso da Petrobras será analisado: uma breve digressão sobre a sua instituição até a sua inserção no mercado de livre concorrência será realizada para facilitar o entendimento sobre o cenário em que foi aprovado o Decreto nº 2.745/1998 por autorização contida no artigo 67 da Lei nº 9.478/1997. Investigar-se-á, então, alguns dos dispositivos do ato citado, com o objetivo de compará-lo com a Lei de Licitações e Contratos, bem como com o de confrontá-lo com a Constituição Federal de 1988. Posteriormente, será exposto o posicionamento do Tribunal de Contas de União acerca da Lei nº 9.478/1997 e do Decreto nº 2.745/1998 e a evolução que esse entendimento sofreu com as sucessivas decisões do Supremo Tribunal Federal em sede de liminar sobre a temática. Por fim, confrontar-se-ão os argumentos relativos à inconstitucionalidade do procedimento licitatório simplificado da Estatal com os que o defendem a constitucionalidade desse procedimento para, assim, traçar um posicionamento firme no presente trabalho sobre a inconstitucionalidade do Decreto nº 2.745/1998. _____________________________________________________________________________ ABSTRACTThis study analyzes the simplified bidding procedure utilized by Petrobras compared to the principle of strict administrative legality. To that effect, it first implements a historic retrospective of the transformation scenario brought about by the Managing Reform in Brazil in the 1990s. In this context, the Constitutional Amendments 9 and 19, respectively of 1995 and 1998, were examined. The first one mitigated oil monopoly and latter instituted the need for a legal statute specific to public companies and mixed economy societies that explore economic activities. It is worth mentioning that the legal regime to which they are subject are detailed to focus mainly on public biddings and contracts. The next section of this study focuses onPetrobras tackling: (i) A brief digression about its creation until liberalization of its market for competition, paving the way to the understanding of the scenario in which the decree no. 2,745/1998 was issuedpursuant article 67 of the Law no. 9,478/1997. This work will investigate the aforementioned act so as to compare it to the Law of Public Biddings and Contracts, as well as to confront it with the Federal Constitution of 1988. Finally, this study addresses arguments of the Brazilian Court of Accounts regarding the Law no. 9,478/1997 and the Decree no. 2,745/1998, and also the evolution of its position, not least after judicial review at the the Supreme Court.
