No intuito de reduzir a presença de aves nas imediações dos aeródromos de forma a evitar a ocorrência de incidentes e acidentes aeronáuticos decorrentes da colisão de aeronaves com aves, resguardando o direito a vida, objetiva-se demonstrar a necessidade de revisão da legislação brasileira aeronáutica atual, bem como obter a tutela do Estado atuando de forma eficaz. A partir da analise das ocorrências de perigo aviário e da legislação brasileira e seus atos regulatórios que tratam do assunto, seja a Portaria nº 1.141/GM5 de 1987, como também, a Resolução CONAMA Nº 4 de 1995 constata-se que ambas não apresentam, de forma clara, os responsáveis pela fiscalização, nem prevêem sanção para casos de descumprimento de normas, tornando-se insuficiente e ineficaz para a solução do problema. Portanto, justifica-se assim a necessidade de legislação mais rigorosa que impute responsabilidade aos agentes públicos e privados envolvidos. Que em seu bojo, sejam previstas infrações penais, tutela do Estado através de ação penal pública incondicionada, com participação efetiva do ministério público. In the intention of reducing the presence of birds in the vicinity of the aerodromes to avoid the occurrence of aeronautical incidents and accidents due to the collision of aircrafts with birds, protecting the right to live, it aims to demonstrate the need of revision of the current aeronautics Brazilian legislation, as well obtain the protection of the State acting in an effective way. Starting from the analyzes of the occurrences of avian danger and of the Brazilian legislation and their regulatory acts that deals with the matter, be the Entrance nº 1,141/GM5 of 1987, as well as, the Resolution CONAMA nº 4 of 1995 we verified that neither one present, clearly, the responsibles for the fiscalization, nor they foresee sanction for cases of noncompliance of norms, becoming insufficient and ineffective for the solution of the problem. Therefore, it is justified in this manner the need of a more rigorous legislation which imputes responsibility to the public and private agents involved. That in its salience, be foresee penal infractions, protection of the State through unconditioned public penal lawsuit, with effective participation of the public prosecution service.
