Inicialmente, far-se-á breve excursão histórica acerca do direito à saúde no Brasil. Analisar-se-á tal direito frente à cláusula da reserva do possível, muitas vezes apresentada como obstáculo à concretização do direito universal, integral e gratuito à saúde. Serão analisados também a estrutura do SUS e o procedimento de incorporação de um medicamento na Anvisa. Posteriormente, serão analisadas duas decisões do Supremo Tribunal Federal acerca do tema. A primeira trata do fornecimento da substância conhecida como pílula do câncer, cujo uso foi liberado para pacientes portadores de câncer sem que a substância tivesse ainda passado pelo crivo da Anvisa. A outra decisão analisada é do Recurso Extraordinário 657.718/MG, que trata especificamente do dever do Estado de prestar medicamento não registrado pela Anvisa. No último capítulo serão apresentados argumentos para se responder à questão da obrigação do Estado de fornecer medicamento ainda não registrado pela autoridade competente. Initially it will be done a brief historical excursion about the right to health in Brazil in wich will be analyzed the Government discretionary action due to budget restraints as an obstacle to the effective health care treatment by the estate. It will be described the structure of the government's system in charge of provide the health care as well the role played by the agency in charge to oversight the procedure of implementation of new medicines. Also, we are going to analyze two cases of Brazil’s Supreme Court. The first decision is about an innovative drug that could, theoretically, cure cancer, wich was released for the treatment of some cancer patients without the necessary government’s approval. The second relates to the State’s duty to provide medicines that were not properly registered by the competent authority. In the last chapter, will be answered the question about the State’s obligation to supply unregistered medicines.
