A realidade dos estabelecimentos de custódia criados para albergar esses indivíduos revela violações de direitos e garantias de proteção social infligindo sobre o infrator com transtorno mental um castigo mais aflitivo que aquele oferecido ao apenado. Nesse sentido, desenvolveu-se uma análise histórico-política dos processos de criminalização e de construção da loucura que fundamentam a intervenção preventiva. A inimputabilidade fôra então definida como objeto de pesquisa investigado e analisado através da configuração do Estado Penal e da atenção a saúde mental no Brasil. Para tanto se recorreu a análise bibliográfica dos estudos brasileiros referentes a questão, revelando-se significativo desvio na proteção aos direitos desses indivíduos. ____________________________________________________________________________ ABSTRACTThe security measure is the state of the instrument used to protect the safety of others determined that in mental disorder who commits an infraction and action time was considered incapable of understanding their illegality. The reality of custodial establishments created to house these individuals reveals rights violations and social protection guarantees inflicting on the offender with mental disorder a more painful punishment than that provided for inmates. In this sense, it has developed a historicalpolitical analysis of the processes of criminalization and madness construction underlying the preventive intervention. The unaccountability then had been defined as a research subject investigated and analyzed by the State Criminal configuration and attention to mental health in Brazil.
