Isso ocorre, no paradoxo da dicotomia – atraso e avanço, de um lado, o modelo arcaico e primitivo de exploração de força de trabalho, contemporâneo por outro lado, o avanço do conhecimento científico e tecnológico e a consequente expansão da produtividade. Na realização do trabalho, utilizou-se como ferramenta, pesquisa bibliográfica, consulta jurisprudencial, informação midiática, relatos e entrevistas de atores relacionados com o trabalho de exploração humana, a redução à condição análoga à de escravo. Presa fácil dessa atividade, a vítima em sua maioria atraída pelo capital, é o indivíduo em situação de vulnerabilidade. A ocorrência do trabalho similar a escravidão apresenta números expressivos de pessoas vitimas, em pleno Século XXI, obscurecendo as lutas e conquistas dos Direitos Humanos no Mundo Ocidental, depois da Segunda Guerra Mundial. Vocacionado aos ideais do constitucionalismo pós moderno, o Constituinte consagrou na Carta Magna, de 1998, os Direitos e Garantias Fundamentais. Isso se deu no anseio de democracia, após o regime militar. Apesar dessa conquista significativa, no sentido de proteger direitos inatos à condição humana, ainda, convivemos no Brasil e noutras partes do Mundo com a exploração de mão de obra com violações de Direitos Humanos e trabalhistas. Nesse cenário, aborda-se neste trabalho, a necessidade de proteção às vítimas dessa atividade laborativa, tão cruel e desumana. Essa tese não possui a intenção de inflacionar o ordenamento jurídico. Alinha-se sobretudo aos ideais do Constitucionalismo pós moderno, a constituição simbólica visando compromisso, indicação, valores, princípios e direitos possíveis de serem alcançados. This is the paradox of the dichotomy - delay and forward, on the one hand, the archaic and primitive model of exploitation of the workforce, contemporary, on the other hand, for the advancement of scientific and technological knowledge and the consequent expansion of productivity. On completion of the work, it was used as a tool bibliographic research, legal consultation, media information, reports and interviews of actors related to the work of human exploitation, the reduction to the condition similar to slave. Easy prey of this activity, the victim in its most attracted to the capital, it is the individual in a situation of vulnerability. The occurrence of similar to slavery presents significant numbers of victims, in the 21st Century, obscuring the struggles and achievements of Human Rights in the Western World after the Second World War. Devoted to the ideals of modern constitutionalism, the Constituent enshrined in Magna Carta, 1998, the Personal Rights and Guarantees. This took place in the desire for democracy, after the military regime. In spite of this significant achievement, in order to protect rights that are inherent to the human condition, still, we socialize in Brazil and other parts of the World with the exploitation of the labor force with violations of Human Rights and labor. In this scenario, we are dealing with in this work, the need for protection of Law for victims of labor activity, as cruel and inhumane. This thesis does not have the intention of inflating the legal system. Aligned especially the ideal of Modern Constitutionalism, the symbolic constitution aimed at compromise, indication, values, principles and rights can be achieved.
