A opção do legislador de não reconhecer, como regra, a legitimidade individual nas ações coletivas gera importantes problemas práticos relacionados invariavelmente com a questão do acesso à justiça. O mais grave deles consiste em tornar o indivíduo, sobretudo naquelas situações em que a lesão experimentada somente pode ser contornada por meio de um provimento judicial coletivo, refém da iniciativa de órgãos públicos e associações. Realidade que se mostra problemática quando se tem em vista que lesões em massa, pela própria característica da vida moderna, estão sendo praticadas a todo o instante, impossibilitando, mormente por questões estruturais, uma atuação eficiente dessas instituições. Esquecida pelo legislador brasileiro, a teoria do interesse pode trazer importantes elementos para justificar o resgate da legitimação individual, explorando as características egoísticas do indivíduo em benefício de todo o grupo no qual se insere, garantindo um sistema mais eficiente de proteção aos direitos coletivos. No entanto, a atuação do indivíduo, quando em exercício do papel de representante dos interesses do grupo, não seria indiscriminada, mas antes seria acompanhada de rígidos mecanismos de controle, notadamente pela necessidade de demonstração de representatividade adequada. ________________________________________________________________________________ ABSTRACTThe object of this work is the lack of the individual’s active legitimacy to propose public civil actions, given the legislative omission of the Public Civil Action Act and of the Code of Consumer Protection on this point. The not recognizing by legislator, as a rule, the legitimacy individual in collective action generates significant practical problems invariably associated with the issue of access to justice. The most serious of them is to force the individual, especially in those situations where the injury experienced can only be overcome through a collective judicial appointment, hostage initiative from government agencies and associations. Reality shows that are problematic when taking into account that mass lesions, the very characteristic of modern life, are being practiced at all times, making it impossible, especially for structural issues, an efficient performance of these institutions. Forgotten by the Brazilian legislature, the theory of interest can bring important elements to justify the redemption of individual legitimacy, selfish exploiting the characteristics of the individual for the benefit of the entire group in which it operates, ensuring a more efficient system for the protection of collective rights.
