Para estudar essa temática, adotou-se a metodologia científica da pesquisa bibliográfica e documental, reforçada por um breve estudo de caso ao final, mediante ampla consulta a: fontes normativas nacionais e internacionais; acordos, tratados e convenções internacionais, bem como suas declarações, resoluções e demais protocolos; jurisprudências oriundas de sentenças proferidas por cortes e tribunais internacionais, ad hoc ou permanentes; obras doutrinárias de autores vinculados à temática em apreço; além de produções textuais da lavra de organizações internacionais reconhecidas. Dessa maneira, este trabalho contempla quatro Capítulos. De início, acompanhou-se o percurso histórico-normativo das águas transfronteiriças, numa contextualização recheada de esclarecimentos técnico-estatísticos relativos ao bem jurídico ‘água’. Em seguida, procedeu-se a uma verificação das nuances referentes à questão hídrica, em abordagem junto às relações jurídico-diplomáticas internacionais. Além disso, confrontaram-se aspectos pertinentes à soberania territorial, em associação com as respectivas visões de povos latino-americanos e de outras nacionalidades. Realizadas essas considerações, adentrou-se na seara do Direito Ambiental Internacional propriamente dito, com o devido suporte de alicerces principiológicos, no intuito de prosseguir com a vertente da poluição, em especial, a hídrica transfronteiriça. Por fim, fez-se a opção de analisar, em breves páginas, alguns dos procedimentos referentes à regulamentação e à correspondente cooperação internacional, junto à Hidrovia Paraguai- Paraná. Com isso, procurou-se contemplar a máxima relevância das manifestações jurídicodiplomáticas em meio às inúmeras circunstâncias correlatas às aguas transfronteiriças, em prol do uso atual e futuro, mediante a devida normatização, assim considerada em seu sentido amplo. ________________________________________________________________________________ ABSTRACTTransboundary waters constitute object to various legal and diplomatic actions, mainly due to the immediate correlation observed between these international actions and their consequences for ensuring a sustainable water use, for present and future generations. To study this issue, it was adopted the scientific methodology of research over literature and documents, reinforced by a brief case study to the end, through broad consultation on: sources of national and international regulations; international agreements, treaties and conventions, as well as his statements, resolutions and other protocols; case law arising from judgments made by courts and tribunals, ad hoc or permanents; doctrinal works of authors linked to the topic at hand; plus textual productions from the pen of recognized international organizations. Thus, this study includes four chapters. Initially, the route was accompanied by historical and legal path of transboundary waters, in a context full of technical and statistical explanations for the legal good ‘water’. Then, it was proceeded to an examination of the nuances regarding the water issue, in approach from legal and diplomatic international relations. Also, they were clashed aspects relevant to territorial sovereignty, in association with the visions of Latin American peoples and from other nationalities. Performed these considerations, it was entered into the yard of the International Environmental Law itself, with due support of principle foundations, in order to proceed with regards to pollution, especially the related with transboundary water. Finally, it was made the option to analyze, in brief pages, some of the procedures concerning the regulation and related international cooperation, along the Paraguay-Parana Waterway.
