A princípio, este seria aplicado apenas às licitações e contratos necessários à realização da Copa das Confederações de 2013, da Copa do Mundo FIFA de 2014, das Olimpíadas e Paraolimpíadas. Entretanto, posteriormente, foram adicionadas algumas outras hipóteses de aplicação do novo regime, como às ações integrantes do Programa de Aceleração do Crescimento – PAC; às obras e serviços de engenharia no âmbito do Sistema Único de Saúde – SUS; às obras e serviços de engenharia para reforma de estabelecimentos penais; às ações no âmbito da segurança pública, entre outras. O novo regime trouxe consigo algumas novidades, por exemplo, a Contratação Integrada, que é o objeto de nosso estudo. A presente monografia tem por objetivo abordar as características, bem como a aplicação da Contratação Integrada cuja responsabilidade pela elaboração dos projetos básico e executivo será do futuro contratado. A bibliografia utilizada abordou o regime da contratação integrada que foi alvo de duras críticas por não possuir projeto básico elaborado previamente à licitação de obras e serviços de engenharia. Esta critica considera a possibilidade de existir contrariedade ao princípio da isonomia e contratações menos vantajosas para a Administração Pública. De acordo com o presente estudo, foi demonstrado que a Administração, mesmo com a ausência do projeto básico elaborado previamente, não está livre garantir a isonomia da disputa, e tampouco está livre de estabelecer regras básicas para garantir uma qualidade mínima do objeto a ser licitado, não se tratando de um instrumento para solucionar problemas de desorganização ou falta de planejamento da Administração. At first, the regime would only be applied to the bids and contracts necessary for holding the 2013 Confederations Cup, the 2014 FIFA World Cup, the Olympics and Paralympics. However, later on, some other hypothesis on the application of the regime were added, such as the actions included in the Growth Acceleration Program (PAC); Engineering works and services within the Unified Health System - SUS; Works and engineering services for the reform of penal establishments; Actions on public security, among others. The new regime brought some news, for example, the Integrated Contracting, which is the object of our study. This monograph aims to address the characteristics as well as the application of the Integrated Contracting in which the future contracted will be responsible for the elaboration of the basic and executive projects. The bibliography used approached the Integrated Contracting regime that was severely criticized for not having a basic project prepared prior to the bidding for engineering works and services. This criticism considers the possibility of existing contradiction to the principle of isonomy and less advantageous contracts for the Public Administration. According to the present study, it was demonstrated that the Administration, even if the basic project is not elaborated previously, is not free to guarantee the equality of the dispute, nor is it free to establish basic rules to guarantee a minimum quality of the object to be bid. The Integrated Contracting is not an instrument to solve disorganization problems or lack of planning from the Administration.
