CONSENSUS AND DISSENT IN RESTORATIVE JUSTICE

Resumo: The article discusses the theoretical ambiguities and conceptual vagueness present in the restorative justice movement. Based on the review of classical contributions and the ongoing international controversy, we systematize the elements that constitute the core of the restorative international consensus and the central elements of the dissent that has been growing, especially the contrasting positions between the "purist" and "maximalist" visions. We then examine, based on a search through Google Scholar, the ten articles published in Portuguese and authored by Brazilian researchers best placed in the bibliometric ranking of the Publish or Perish software. We find that the previously discussed theoretical  ambiguities and indefinitions make restorative strands possible in Brazil with contrasting positions, which suggests the need for a more consistent theoretical basis for the restorative movement. We conclude by suggesting a path for overcoming some of the existing polarizations.

A partir da revisão das contribuições clássicas e da polêmica internacional em curso, sistematizamos os elementos que constituem o núcleo de consenso internacional restaurativo e os elementos centrais do dissenso que tem se ampliado, especialmente a partir das visões “purista” e “maximalista”. Examinamos, então, em pesquisa no Google Scholar, os dez artigos publicados em português de autoria de autores brasileiros mais bem situados no ranking bibliométrico do software Publish or Perish. Encontramos que as referidas ambiguidades e indefinições tornam possível vertentes restaurativas no Brasil com posições contrastantes, o que sugere a necessidade de uma base teórica mais consistente para o movimento restaurativo.
