THE CONSTITUTIONALIZATION OF ADMINISTRATIVE LAW FOR A MODEL OF DEMOCRATIC PUBLIC ADMINISTRATION

This article analyzes the hermeneutic movement of constitutionalization of administrative law, from its causes and consequences and, notably, supported by the theory of mitigation of the principle of legality by the new concept of legality, providing the exercise of the administrative function under the protection of interpretation of the Federal Constitution. Through the deductive method, it will be concluded that the Public Administration, especially in the exercise of the atypical function of legal decision for the realization of the text-right, is bound, a priori of ordinary law, to constitutional law, to the aim of realizing fundamental rights as a substantial face of a public interest shaped by social participation, declining the dialogic and democratic content of state decision-making processes.
