The use of geographical indication in the protection and appropriation of agri-food cultural heritage: the cases of Goiabeiras, Serro and Canastra

Resumo: The food heritage, here considered intangible cultural heritage, has value for the communities that own it and for the market. As it has a market value, such heritage requires some form of protection that allows for its appropriation. Intellectual Property Rights (IPR), created to protect the spirit's creations, have been considered as a system capable of guaranteeing protection to the food heritage. The objective of this text is to discuss the possibility of using IPR, especially geographical indications (GI), as a way of appropriating the food heritage from a theoretical review and observation of two cases of intangible heritage: the craft of pans from Goiabeiras and the ways of making Serro and Canastra cheeses It is concluded that the GI of the cases mentioned, with due care, can be used in the appropriation of food heritage.

Como tiene un valor de mercado, dicho patrimonio requiere alguna forma de protección que permita su apropiación. Los Derechos de Propiedad Intelectual (DPI), creados para proteger las creaciones del espíritu, han sido considerados como un sistema capaz de garantizar la protección del patrimonio agroalimentario. El objetivo de este texto es discutir la posibilidad de utilizar los DPI, especialmente las indicaciones geográficas (IG), como una forma de apropiarse del patrimonio agroalimentario a partir de una revisión teórica y observación de dos casos de patrimonio inmaterial: la artesanía de las sartenes en Goiabeiras y las formas de elaboración de los quesos Serro y Canastra. Se concluye que las IG de los casos mencionados, con el debido cuidado, pueden ser utilizadas en la apropiación del patrimonio agroalimentario.O patrimônio agroalimentar, aqui considerado patrimônio cultural imaterial, possui valor para as comunidades que o detêm e para o mercado. Por possuir valor mercadológico, tal patrimônio demanda alguma forma de proteção que permita a sua apropriação. Os Direitos de Propriedade Intelectual (DPI), constituídos para proteger as criações do espírito, vem sendo considerados como um sistema passível de garantir proteção ao patrimônio agroalimentar. O objetivo deste texto é discutir a possibilidade de uso dos DPI, especialmente, das indicações geográficas (IG), como forma de apropriação do patrimônio agroalimentar a partir de uma revisão teórica e da observação de dois casos de patrimônio imaterial: o ofício das panelas de Goiabeiras e os modos de fazer os queijos do Serro e da Canastra.
