Heritage, environmental legislation and licensing: analysis of educational actions in consultative archeology processes carried out in oeste catarinense (2012-2018)

Resumo: The purpose of this work is to present the educational actions that arise from the environmental licensing processes in relation to archaeological studies, making a comparison of two normative bodies, constituted by Ordinance No. 230/2002 and Normative Instruction No. 001 / 2015, both emanated from the National Institute of Historical and Artistic Heritage (IPHAN). From the analysis of the data, it could be inferred that although there are some inconsistencies with regard to Heritage Education,both normative instruments constitute an advance in the matter of cultural legislation, regulating the protection of cultural property in environmental licensing projects, also worrying about the dissemination of the results to the communities surrounding the projects.

From the analysis of the data, it could be inferred that although there are some inconsistencies with regard to Heritage Education,both normative instruments constitute an advance in the matter of cultural legislation, regulating the protection of cultural property in environmental licensing projects, also worrying about the dissemination of the results to the communities surrounding the projects.El propósito de este trabajo es presentar las acciones educativas que surgen de los procesos de de licenciamiento ambiental en relación con los estudios arqueológicos, haciendo una comparación dos cuerpos normativos, constituidos por la Ordenanza No. 230/2002 y la Instrucción Normativa No. 001/2015, ambas emanadas el Instituto de Patrimono Histórico y Artístico Nacional (IPHAN). Del análisis de los datos, se pudo ver que aunque existen algunas inconsistencias con respecto a la Educación Patrimonial, ambos instrumentos normativos constituyen un avance en materia de legislación cultural, regulando la protección de los bienes culturales en los proyectos de licenciamiento ambiental, preocupándose también por la difusión de los resultados a las comunidades aledañas a los proyectos. La IN nº 001/2015 que es la más reciente y actualmente vigente, presenta un mayor detalle sobre los requisitos relacionados con las acciones educativas si se compara con la Ordenanza nº 230/2002. Cabe señalar que, en los procesos analizados en la IN No. 001/2015, se observaron diferencias significativas en relación a la Ordenanza No. 230/2002 y un mayor esfuerzo de los profesionales para cumplir con la legislación y calificar las actividades desarrolladas, buscando integrar cuestiones relacionadas con la educación patrimonial, aunque estos no fueran obligatorios en las fases de los proyectos analizados.O objetivo deste artigo é apresentar a análise das ações educativas que foram desenvolvidas em processos de arqueologia vinculadas ao licenciamento ambiental, realizando uma comparação entre a Portaria nº 230/2002 e a Instrução Normativa nº 001/2015 – ambas lançadas pelo Instituto do Patrimônio Histórico e Artístico Nacional (IPHAN).
