The potential of good compliance practices to strengthen the safeguarding of agrifood intangible heritage

Resumo: The Cultural Heritage Law, as a branch of the Law Science, is autonomous in relation to the Environmental Law. On the other hand, the safeguarding of the Intangible Cultural Heritage in Brazil occurs mainly through registry, a mechanism created by the Federal Decree no. 3.551/2000. Yet, the protection acts that have arisen from this instrument seem to be insufficient in the face of the Agri-Food Intangible Heritage singularities. For this reason, a theoretical research supported by document analysis as well as socio-legal references was conducted to check if Compliance best practices, according to the parameters established by the national legal and regulatory norms applicable to private companies, could potentially contribute to safeguarding the Agri-Food Heritage. At last, this study revealed that these practices implemented by the Integrity Program can strengthen the protection surrounding the collective organizations formed of traditional foodways maintainers.

A su vez, la salvaguardia del Patrimonio Cultural Inmaterial en Brasil ocurre sobre todo por medio del registro, creado por el Decreto n.º 3.551/2000. Todavía sus acciones de protección parecen ser insuficientes frente a las peculiaridades del Patrimonio Agroalimentario. Así en investigación teórica apoyada en el método de análisis documental y en referencias sociojurídicas, se investiga si las buenas prácticas de compliance, analizadas desde parámetros establecidos por las normas nacionales aplicables a empresas privadas, tienen el potencial de contribuir al refuerzo de la salvaguarda del Patrimonio Agroalimentario. Finalmente, se concluye que estas prácticas, en el Programa de Integridad, pueden fortalecer la protección de las organizaciones colectivas formadas por tenedores de modos de hacer productos agroalimentarios.O Direito do Patrimônio Cultural é autônomo em relação ao Direito Ambiental, já que a tutela jurídica aos bens naturais não se aplica aos bens culturais de maneira adequada. Por sua vez, a salvaguarda do Patrimônio Cultural Imaterial no Brasil ocorre, sobretudo, por meio do registro, mecanismo criado pelo Decreto n.º 3.551/2000. No entanto, as ações de proteção decorrentes desse instrumento parecem ser insuficientes diante das peculiaridades do Patrimônio Imaterial Agroalimentar. Por isso, em pesquisa teórica apoiada no método de análise documental e subsidiada por referências sociojurídicas, foi investigado se as boas práticas de Compliance teriam o potencial de contribuir para a salvaguarda do Patrimônio Agroalimentar.
