This article, based on the use of the deductive method and bibliographic, doctrinal and jurisprudential analysis, aims to investigate the civil liability regarding the theft of vehicles inside shopping centers, agreed or not by means of a deposit contract. For this purpose, the existing theories on the subject will be analyzed, and the doctrinal and jurisprudential proposals on the basis of civil liability will be discussed, in order to prove the objective liability of commercial establishments in these cases, in addition to how the Consumer Defense Code is applied and the characterization of the relationship as a consumerist. The issue has relevance since the event is common in the daily live of people who use this service in shopping centers. As a conclusion to the research, doctrine and Brazilian law establish the understanding that the parking lots are liable regardless of fault, for the damages caused, thus establishing objective civil liability.
