Resumo: The present work aims to analyze the querela nullitatis dispute in the Brazilian legal system, through the historical reconstruction of the institute, under the prism of res judicata, in its hypotheses of relativization. Once this is done, we seek to analyze the doctrinal and jurisprudential understanding of the action and its appropriate hypotheses.
