This paper presents and analyzes elements, characteristics and main aspects of insurance and health plans, especially the issues of market that exists in this segment. In this regard, it addresses the characteristics of these contracts, the rights and duties of the participants in these consumer relations, including characteristics and aspects related to the supply chain and the final consumers of the services (around ¼ of the Brazilian population has such a contract) . Working with legal and economic conceptions, this study not only analyzes the main problems that affect the sector, involving business issues, regulation, reasons that lead to the phenomenon of judicialization, but also the protection of consumers, including personality rights. And, complementing, it expresses considerations and suggestions aiming to contribute doctrinally to the possible solutions pointing to the objective of sustainability and improvement of the sector.
