Insufficiency of the Judiciary in Chiapas and Mediation as an Alternative to Justice

Resumo: The article analyzes Alternative Dispute Resolution Mechanisms, a human right enshrined in article 17, paragraph 5, of the Political Constitution of the United Mexican States, focusing especially on mediation, taking as reference the case of Chiapas that in view of the crisis that the administration of justice is going through, it makes us think of this mechanism as a method of solving conflicts in a prompt and effective manner. To reach such a conclusion, the analytical method and the handling of documentary sources will be used.

En el artículo se analiza a los Mecanismos Alternativos de Solución de Controversias, derecho humano consagrado en el artículo 17, párrafo 5, de la Constitución Política de los Estados Unidos Mexicanos, enfocándose especialmente en la mediación, tomando como referencia el caso de Chiapas que ante la crisis por la que atraviesa la administración de justicia hace pensar en este mecanismo como un método de solución de conflictos de manera pronta y eficaz. Para llegar a tal conclusión se hará uso del método analítico y el manejo de fuentes documentales. O artigo analisa os Mecanismos de Resolução Alternativa de Controvérsias, direito humano consagrado no artigo 17, parágrafo 5º, da Constituição Política dos Estados Unidos Mexicanos, com foco especial na mediação, tomando como referência o caso de Chiapas que em face da crise que a administração da justiça está em curso, faz-nos pensar neste mecanismo como uma forma de resolver conflitos de forma ágil e eficaz. Para chegar a tal conclusão, será utilizado o método analítico e o manuseio de fontes documentais.
