Acknowledgement of the Rights of Transsexuals as Rights of the Person

Resumo: Transsexuality as an inconsistency of gender is analyzed. Transsexual persons are characterized by the desire to adequate their anatomical sex to their psychosocial one. The principles of the dignity of the human person, the autonomy of freewill, and equality and freedom foreground the free exercise of gender identity of transsexual persons who feel discomfort within the social heteronormative standard and its sexual fitness. These principles warrant their recognition and inclusion within society as a fulfillment of rights and individual quarantees. The transsexual persons rights are violated when these persons are denied sexual consistency, change of name and sexual identity in their civil certificates. Results show that the fulfillment of transsexual persons´ rights will occur when norms are promulgated that would warrant the consequences of their sexual accomplishment and equal treatment, the prohibition of any discrimination and victimization, and their acknowledgement by social institutions.

El transexual es caracterizado por el deseo de readecuar su sexo anatómico en conformidad con su sexto psicosocial. Los principios de la dignidad humana, de la autonomía, de la voluntad, de la igualdad y de la libertad es que fundamentan el libre ejercicio de la identidad de género del individuo transexual que no se encasilla en el patrón social heteronormativo y la readecuación sexual de este, garantizando su reconocimiento y su inclusión en la sociedad como medio de ejecución de los derechos y garantías individuales. De esta forma, los derechos de la personalidad del transexual son infringidos cuando de la negativa de la readecuación sexual y del cambio del nombre y de la identidad sexual en el registro civil. Se concluye que la ejecución de los derechos de la personalidad de los transexuales solo ocurrirá cuando haya una reglamentación que venga tutelar las consecuencias de la readecuación sexual de ellos, permitiendo, así, un tratamiento igualitario, vedando cualesquiera formas de discriminación y victimización y un reconocimiento por las instituciones sociales.Nesta pesquisa analisa-se a transexualidade, que consiste em uma disforia de gênero. O transexual é caracterizado pelo desejo de readequar o seu sexo anatômico em conformidade com o seu sexo psicossocial. Os princípios da dignidade da pessoa humana, da autonomia da vontade, da igualdade e da liberdade é que fundamentam o livre exercício da identidade de gênero do indivíduo transexual que não se enquadra no padrão social heteronormativo e a readequação sexual deste, garantindo seu reconhecimento e sua inclusão na sociedade como meio de efetivação dos direitos e garantias individuais. Desta forma, os direitos da personalidade do transexual são infringidos quando da negativa da readequação sexual e da mudança do nome e da identidade sexual no registro civil.
