Dieselgate: The Social Function of a Firm in the Prevention, Removal and Reparation of Damages

Resumo: Research investigates the inhibition of violation of human rights from the point of view of social entrepreneurship within the context of corporative environment through a case study, specifically, manufacturers of cars implied in the so-called Dieselgate. It investigates how internationals norms and the firm´s social function may inhibit such cases. The induction method is employed in the study of materials on the theme and the hypothesis-deduction in the study of legislation concerned. Results show that further activities should be undertaken so that big firms may comply to entrepreneur activity and respect for human and individual rights of third parties.

En la presente investigación se pretende analizar, bajo la óptica de la función social empresarial, la cohibición de la violación de Derechos Humanos en el ambiente corporativo, mediante estudio de caso, específicamente, de las fabricantes de vehículos implicadas en el Dieselgate. Indaga cómo las normativas internacionales, así como la función social de la empresa, pueden prevenir la ocurrencia de casos de ese tipo. Se utilizará el método inductivo en el estudio de materias especializadas sobre el tema y el hipotético deductivo en el estudio de la legislación. Se concluye que todavía hay mucho a hacerse para las grandes empresas se adecuen y compatibilicen la actividad empresarial y el respeto a los derechos humanos e individuales de terceros.A presente pesquisa pretende analisar, sob o prisma da função social empresarial, a coibição da violação de Direitos Humanos no ambiente corporativo, mediante estudo de caso, especificamente, das fabricantes de veículos implicadas no Dieselgate. Indaga como as normativas internacionais, bem como a função social da empresa, podem prevenir a ocorrência de casos desse tipo. Utilizará o método indutivo no estudo de matérias especializadas sobre o tema e o hipotético dedutivo no estudo da legislação.
