Resumo: The debate on contemporary democracy in terms of the social subjects participation implies understanding, among other issues, two important aspects of this process: the idea of access to justice and the concept of social control, focused on the social and collective perspective. Accordingly, the objective of this work is to point out some reflections on the construction of the law idea, its access and social control in the context of redemocratization in a national and international perspective, despite its ideological diversity, highlighting the role of ONG’s in this process.

Así, el objetivo de este trabajo es hacer algunas reflexiones sobre la construcción de la idea de derecho, su acceso y control social, en el contexto de redemocratización en una perspectiva internacional y nacional, no obstante sus idiosincrasias ideológicas, destacando el papel de las ONG’s en este proceso.A discussão sobre a democracia contemporânea na perspectiva da participação dos sujeitos sociais implica em compreender, dentre outras questões, dois aspectos importantes deste processo: a idéia de acesso à justiça e o conceito de controle social, focados na perspectiva dos direitos sociais e coletivos.
