The sluggishness of the judiciary and its interference in contractual relations

Resumo: The sluggishness of the Judiciary generates negative effects for the Brazilian economy. There are losses in contractual relations that result from this inefficiency of the state machine in judging cases in a timely manner. The paper demonstrates that the delay generates a disincentive to the conclusion of the contract. More specifically, it analyzes its influence on banking contracts, labor relations and contracts with under-sufficient parties. The methodology adopted is descriptive-argumentative through a bibliographic survey and jurisprudential analysis.

El artículo demuestra que la demora genera un desincentivo a la celebración del contrato. Más concretamente, analiza su influencia en los contratos bancarios, las relaciones laborales y los contratos con partes insuficientes. La metodología adoptada es descriptiva-argumentativa a través de levantamiento bibliográfico y análisis jurisprudencial.A morosidade do Poder Judiciário gera efeitos negativos para a economia brasileira. Há prejuízos nas relações contratuais que decorrem dessa ineficiência da máquina estatal em julgar os processos a tempo e a modo. O artigo demonstra que a morosidade gera um desestímulo à celebração do contrato. Analisa mais especificadamente sua influência nos contratos bancários, nas relações trabalhistas e nos contratos com partes hipossuficientes.
