Human Rights in Schooling

Resumo: Law concepts within the labor, social and private milieu, through the different communications media, motivated by disagreements, debates or simple chatting, are dealt with by all in everyday life. Awareness of rights is indispensible for the materialization of these very rights. Current essay shows how the science of Law was forwarded to the school community through the establishment of a discipline called ‘Fundamental Juridical Concepts’ within the heterogeneous section of the curriculum. A bibliographical research was undertaken as a preliminary part of the analysis. It consisted of a delimitation of themes, such as, introduction to the science of Law, law-society-state; general notions on the constitution of Brazil, labor laws, rights of consumers, human and fundamental rights, constitutional guarantees and access to justice. A pilot school was selected for the ministration of lessons, manual works, group dynamics, film exhibitions, schoolwork involving music, and debates, during eight months, two hours a week. Initial evaluation consisted of questionnaires before and after schoolwork, with 11.2% of positive scores; 30.9% negative scores; 57.9% doubts. After the set of lessons, there were 89.4% positive scores; 6.3% negative scores and 4.3% doubts. A 78.1% increased occurred in positive scores and a decrease of 24.5% and 53.4% respectively in negatives scores and doubts occurred. Results show that the learning on basic notions of Law occurred. It was actually a process for the propagation of indispensible concepts for all sections of life, providing people with legitimate tools of inclusion, participation and social intervention.

Conquanto a conscientização dos direitos é indispensável para a efetivação dos mesmos. Assim, o objetivo do trabalho foi levar a ciência do direito junto à comunidade escolar, através da implantação da disciplina “noções jurídicas básicas” na parte diversificada do currículo escolar. Para o efetivo desenvolvimento do trabalho optou-se preliminarmente como fonte de estudo pela pesquisa bibliográfica atendendo à delimitação dos temas a serem ministrados, dentre eles: introdução à ciência do direito, direito-sociedade-estado, noções gerais da constituição da república, do direito do trabalho, do direito do consumidor, dos direitos humanos e fundamentais, das garantias constitucionais e acesso à justiça. Posteriormente designou-se a escola-piloto onde foram desenvolvidas aulas expositivas, trabalhos manuais, dinâmicas em grupo, apresentação de filmes, trabalhos com músicas, trabalhos lúdicos e debates, durante oito meses, com duração de duas horas-aulas semanais. A critério avaliativo foram aplicados questionários idênticos, antes e após o trabalho. Obteve-se inicialmente 11,2% de acertos, 30,9% de erros e 57,9% de dúvidas; após o trabalho os índices foram: 89,4% de acertos, 6,3% de erros e 4,3% de dúvidas. Portanto, houve aumento de 78,1% nos acertos e diminuição de 24,5% e 53,4% nos erros e dúvidas, respectivamente. Logo, é possível afirmar que ocorreu efetivo aprendizado das noções básicas de direitos.
