Ruggie Principles, access to information and the protection of workers´ mental health in Mato Grosso do Sul

Resumo: Access to information, guaranteed by the Brazilian Constitution, is indispensable for the development of a democratic society. The paper investigates the manner access to information has impacted the parameters “protect, respect and repair”, conducted to the Ruggie Principles. The latter establishes the obligation of States, the accountability of companies and the need of efficient resources for the protection of human rights and the reparation of harm when violated. Focus comprises work environment in the state of Mato Grosso do Sul, Brazil, especially with regard to health protection of the workers. Hypothesis deals with information access for the improvement of state and corporative work. The inductive method was employed and procedures comprise secondary data analysis of official documents, coupled to review of the literature.

De ese modo, se estudia de qué modo el acceso a la información hace impacto sobre los parámetros “proteger, respetar y reparar” que conducen los Principios Ruggie, documento en el cual se estableció la obligación de los Estados, la responsabilidad de las empresas y la necesidad de recursos eficientes a la protección de los derechos humanos, así como la previsión de reparación de los daños en caso de violación. En este estudio, el enfoque es el ambiente laboral de Mato Grosso do Sul - MS, especialmente en la perspectiva de la protección de la salud mental del trabajador. La posibilidad incide en la necesidad del acceso a la información para mejorar la actuación estatal y corporativa. Para tal, se utiliza del método de abordaje inductivo, y los procedimientos son los análisis de dados secundarios de documentos oficiales, y revisión bibliográfica sobre el tema. O acesso à informação é um direito humano fundamental garantido na Constituição Federal, indispensável para o desenvolvimento de uma sociedade democrática. Destarte, estuda-se de que modo o acesso à informação tem impacto sobre os parâmetros "proteger, respeitar e reparar" que conduzem os princípios Ruggie, documento no qual se estabeleceu a obrigação dos Estados, a responsabilidade das empresas e a necessidade de recursos eficientes na proteção dos direitos humanos, bem como a previsão de reparação dos danos em caso de violação. Neste estudo, o foco é o ambiente de trabalho de Mato Grosso do Sul - MS, especialmente na perspectiva da proteção da saúde mental do trabalhador. A hipótese incide na necessidade do acesso à informação para melhorar a atuação estatal e corporativa. Para tal, utiliza-se do método de abordagem indutivo, e os procedimentos são as análises de dados secundários de documentos oficiais, e revisão bibliográfica sobre o tema.
