The Semiology of Power and the Symbolic Man: Referents for an (Re) Assessment of the Law

Resumo: The law, perceived as a product and, at the same time, a source of culture, establish ways of communication that change with the subjective ordinary life interactions. These different ways of cultural communication are not always perceived by the Law itself, engendering false representations of social life. For this reason it is necessary to establish mechanisms in order to seek fundaments on which the juridical discourse may be based concerning its normative aspect. This work takes shape from the Semiology of Power, from the meaning of the Symbolic Man and from the Philosophy of Ordinary Language. The methodological actions that outline this work are: General Objective: investigate if the categories Semiology of Power and Rights concretize the elaboration of a discourse that takes into consideration everyday language; Specific Objectives: a) formulate considerations on the Juridical Science as a cultural phenomenon; b) consider the categories Semiology of Power, Philosophy of Ordinary Language and Symbolic Man as an idea of the construction of a legitimate Law when it analyzes the ideological loads of the juridical discourse. The methodological criterion used to carry out this reflection is based on the inductive method.

Esas formas de comunicación cultural, ni siempre son percibidas por el propio Derecho, engendrando representaciones de la vida social. Por ese motivo, es necesario establecer mecanismos para procurarse los fundamentos que fundamentan el discurso jurídico en su aspecto normativo. Este trabajo se concretiza por la Semiología del Poder, por el significado del Hombre Simbólico y por la filosofía del Lenguaje Ordinario. Las categorías Semiología del Poder y Derecho concretizan la elaboración de un discurso que pueda contemplar el lenguaje del cotidiano. Objetivos específicos: a) enunciar consideraciones acerca de la Ciencia Jurídica como un fenómeno de cultura; b) considerar las categorías de construcción para un Derecho legítimo cuando aquel analiza las cargas ideológicas del discurso jurídico. El criterio metodológico utilizado para realizar esa reflexión es el método inductivo.O Direito, percebido como produto, e ao mesmo tempo, fonte de cultura, estabelece formas de comunicação que se modificam, nas interações subjetivas do cotidiano. Essas formas de comunicação culturais, nem sempre são percebidas pelo próprio Direito, engendrando falas representações da vida social. Por esse motivo, é preciso estabelecer mecanismos, necessários, para se procurar os fundamentos que embasam o discurso jurídico em seu aspecto normativo. Este trabalho se concretiza pela Semiologia do Poder, pelo significado do Homem Simbólico e pela Filosofia da Linguagem Ordinária. As providências metodológicas para delinear este trabalho são: Objetivo geral: investigar se as categorias Semiologia do Poder e Direito concretizam a elaboração de um discurso que contemple a linguagem do cotidiano; Objetivos específicos: a) formular considerações acerca da Ciência Jurídica como um fenômeno de cultura; b) considerar as categorias Semiologia do Poder, Filosofia da Linguagem Ordinária e Homem Simbólico como a idéia de construção para um Direito legítimo quando aquele analisa as cargas ideológicas do discurso jurídico.
