The Image Personality, Honor, Privacy and Intimacy Rights of the Employee in the Work Relations

Resumo: This paper aims to analyze some of the personal rights of the employee in the workplace. It discusses the concept, personality characteristics and makes a conceptual distinction between personal rights and liberties. Among the illustrative list of personal rights of workers stipulated in Article 21 of the Civil Code it will be analyzed the image, privacy, honor, privacy rights, protected, instead by the Federal Constitution, in Article 5, sections V and X. There were collated some examples and tried for violation of those rights, that may be applicable to punitive damages. In this context, refers to the sense and the need for limits on the steering power of the employer, with emphasis on the supremacy of human dignity.

Trata del concepto, características de los derechos de personalidad y hace una distinción conceptual entre derechos de personalidad y libertades públicas. En el rol de los derechos de personalidad de los trabajadores, dispuestos en el Art. 21 del código Civil serán analizados el derecho a la imagen, a la intimidad, a la honra y a la privacidad, tutelados, otrosí, en la Constitución Federal, en el Art. 5º, incisos V y X. Fueron cotejados algunos ejemplos prácticos y juzgados de violación de esos derechos, en que cabe indemnización por daños morales. En ese contexto, se menciona todavía, el buen sentido común y la necesidad de límites cuanto al poder directivo del empleador, con destaque a la supremacía de la dignidad de la persona humana.O presente trabalho tem como escopo analisar alguns dos direitos da personalidade do empregado no ambiente de trabalho. Aborda o conceito, características dos direitos de personalidade e faz uma diferenciação conceitual entre direitos da personalidade e liberdades públicas. Dentre o rol exemplificativo dos direitos da personalidade dos trabalhadores, dispostos no artigo 21 do Código Civil serão analisados o direito à imagem, o direito à intimidade, o direito à honra e o direito à privacidade, tutelados, outrossim, na Constituição Federal, no artigo 5º, incisos V e X. Foram colacionados alguns exemplos práticos e julgados de violação desses direitos, que são cabíveis de indenização por danos morais.
