Freedom of Information, Versus the Personality Rights: Honor, Image and Privacy

Resumo: The Brazilian press has gone through struggle times for freedom of information, struggle that still exists expecting the approval of the Law Project 3.232-A/92. The personality rights have support in the Federal Constitution of 1988 in the article 5th, X, but suffer when the restricted freedom of information as provided in the article 20 and 21, from the same law, has just been over them. The legal protection of these institutes will depend on the actions of the judge in each particular case, taking into consideration the rights to the image, honor and privacy, and also considering the exceptions where the information being reported has important public interest.

Los derechos de personalidad poseen respaldo en la Constitución Federal de 1988, en el art. 5º, X, pero sufren restricciones cuando la libertad de información, prevista en los arts. 20 y 21, del mismo diploma legal, acaba sobreponiéndose a éstos. La protección jurídica de estos institutos dependerá de la actuación del magistrado, en cada caso particular, llevándose en consideración los derechos a la imagen, al honor y a la privacidad y, también, sopesando las excepciones donde la información que va a ser noticiada posee relevante interés público.A imprensa brasileira passou por momentos de luta pela liberdade de informação, luta que ainda persiste enquanto se aguarda a aprovação do Projeto de Lei n. 3.232-A/92. Os Direitos da Personalidade possuem respaldo na Constituição Federal de 1988, no art. 5º, X, mas sofrem restrições quando a liberdade de informação, prevista nos arts. 20 e 21, do mesmo diploma legal, acaba se sobrepondo a estes.
