Resumo: The theme of this article is to study and analyze the economic-financial order and the positivation of the Economic Freedom Law, in the light of the economic analysis of law. The general objective is to trace the conceptual nature, main characteristics and effects for the legal ordering of the Economic Freedom Law, in particular the guidelines contained in article 5 of the respective law. The specific objective is to demonstrate that the Law on Economic Freedom seeks to be founded on the principles of article 170 of the Federal Constitution of 1988, in particular that of free Initiative, free competition and freedom to undertake, determining that the editing or amendment of normative acts should analyze the regulatory and economic impact, positing the theory of economic analysis of law. The methodology to be observed will be the bibliographic procedure, through the deductive method, with a qualitative approach.

El objetivo general es trazar la naturaleza conceptual, las características principales y los efectos para el ordenamiento jurídico de la Ley de Libertad Económica, en particular las directrices contenidas en el artículo 5 de la respectiva ley. El objetivo específico es demostrar que la Ley de Libertad Económica busca fundamento en los principios del artículo 170 de la Constitución Federal de 1988, especialmente la libre empresa, la libre competencia y la libertad de emprender, determinando que la emisión o modificación de actos normativos, debe analizar el impacto regulatorio y económico, postulando la teoría del análisis económico del derecho. La metodología a observar será el procedimiento bibliográfico, a través del método deductivo, con enfoque cualitativo.O tema deste artigo é estudar e analisar a ordem econômico-financeira e a positivação da Lei da Liberdade Econômica, sob a luz da análise econômica do Direito. O objetivo geral é traçar a natureza conceitual, principais características e os efeitos para o ordenamento jurídico da Lei da Liberdade Econômica, em particular as diretrizes contidas no artigo 5º da respectiva lei. O objetivo específico é demonstrar que a Lei da Liberdade Econômica busca fundamento nos princípios do artigo 170, da Constituição Federal de 1988, em especial ao da livre iniciativa, livre concorrência e da liberdade de empreender, determinando que a edição ou alteração de atos normativos, devem analisar o impacto regulatório e econômico, positivando a teoria da análise econômica do direito.
